Dear Mr. Chung,

I oppose the 404 permit under Sect. 404 of the Clean Water Act because of the bad effects that would impact the waters of the United States.

The project would require amending of the Foothill/Trabuco Specific Plan (FTSP), destroying biologic, water quality, and other natural features of importance to all of us. The impacts of this project go against existing planning, reversing decisions made more than a decade ago, in 1991.

The bad effects include destruction of wildlife corridors, loss of ancient oak trees and the canopy they create and that impact on the rivershed and the waters of the United States. I oppose the Orange County EIR #578, which would allow this project, as inadequate and misleading. The FTSP's resource protection guidelines should be applied to all proposed developments in the area, not amended for individual developers.

San Diego Superior Court (Aug., 2002) struck down the County of Orange's attempt to amend the FTSP for the "Rancho Potrero Leadership Academy," (USACE permit #200001011-YJC) because changes were "arbitrary and capricious" and carving a special district exempt from the FTSP rendered it internally inconsistent.

Aliso Creek is already impaired, and exceeds Basin Plan Objectives. Further development in the Aliso Creek watershed would have unacceptable results for the quality of life for humans and what's left of the habitat, including sediment transport, erosion, particulate deposition, and many other deleterious effects. Please refuse the permit.
